UDU – IN its bid to foster a harmonious working relationship amongst stakeholders, the Nigerian Bar Association, NBA, Udu Branch on Sunday had an interactive session with the Police, Road Safety Officials and Chief Magistrates of Udu and Effurun.

The proactive strategy was the brain child of the new executive led by Kingsley Asagba Esq.

The well attended meeting which held at the Grace Model Group of Schools Ovwian had Chief Andrew Orugbo Esq, former Attorney General and Commissioner for Justice Delta State as the moderator.

In attendance were, Chief Magistrate Effurun, Ena Odjugo Esq, his Udu Area Magisterial Counterpart, T.J. Nzekwu Esq, ACP Anche Joseph, Police Area Commander Burutu Command, CSP Aliyu Shabba, DPO Ovwian/Aladja Division and ACC Danjuma Goji, Road Safety Unit Commander.

In his opening speech, Chief Andrew Orugbo welcomed every participant, noting that it was a great day for a new beginning and called for understanding.

The former AG Delta State also revealed that what causes friction amongst stakeholders saddled with dispensation of justice is the inability to fight and seek justice.

He insisted that every stakeholder should ensure that the rule of law prevails above primordial sentiments.

On his part, ACP Anche Joseph, Police Area Commander Burutu Command said that the major problems between the police and lawyers most times is ‘gap in communication’, he calls for mutual respect and understanding.

The Police Area Commander said that most lawyers once briefed by their clients go to the police station with sentiments without hearing the other side of the complaints against their client.

He noted that if police receive complaints and make an arrest, they have to do investigations before bail can be granted, he urged lawyers to do preliminary investigations when they are briefed. He also emphasis the need for police officers to differentiate between criminal and civil matters as some petitions are coined to have criminal colouration whereas the issue is purely civil. He went further to clarify the fact that bail is free and lawyers should not accept to pay money for bail or use money to tempt police officers to get their clients on bail.

CSP Aliyu Shabba, DPO Ovwian/Aladja Division while speaking aligned himself to the position of the Police Area Commander and called for understanding amongst stakeholders in the justice sector.

Chief Magistrate and administrative magistrate, Effurun magisterial district, Ena Odjugo Esq in his address urged stakeholders to show courtesy to one another and calls for regular interaction amongst stakeholders.

Odjugo promised a continuous harmonious relationship with the police, lawyers and Road Safety Officials and called for respect for the ethics of the professions.

Chief Magistrate and administrative magistrate, Udu magisterial district, T.J. Nzekwu, Esq, on his part thanked the Udu Bar leadership for the initiative, insisting that everyone should treat others the way they want to be treated.

Nzekwu urged the Road Safety Officials to giver concession in minor infractions due to the harsh economic situation in the country and shouldn’t be quick to punish.

The Learned Magistrate called for empathy, urging everyone to put himself on the other person’s position.
On his part, the Unit commander, Federal Road Safety Corp, Mr. Danjuma Goji, calls for the need for cordial relationship between lawyers and the road safety officials but that lawyers should try and have the necessary facilities such as fire extinguishers in their cars. He posited that safety is everyone’s duty. He further assured that he will talk to his men to stop whatever embarrassment on lawyers or judicial officers as the “esprit de corp” should be extended.

Several lawyers including C.D.S. Omon-Irabor Esq also made their contributions on how to foster a harmonious working relationship between the police and lawyers.

The NBA Udu Chairman, Kingsley Asagba Esq expressed his gratitude to the guests and members for taking time out to work for a better relationship.

Asagba stated that his administration will work hard to achieve cordial relationship between the police, road safety officials, lawyers and the court and that this interactive session will be a continuous exercise to ensure that lawyers work in a friendly environment without any form of intimidation or fear.

Pipeline Contract : Group Knocks Rita-Lori Ogbebor, Asari Dokubo

High Chief Government Ekpemupolo

*Says Only Those Involved In Illegal Oil Bunkering Will Go Against The Pipeline Contract

The Niger Delta Movement For Radical Change (NDMRC) has rained heavy knocked on Chief (Mrs) Rita-Lori Ogbebor on her position on the #4.5 Billion pipeline contract awarded by the NNPC and the Federal Government to Chief Government Ekpemupolo aka Tompolo, accusing her of promoting tribal war

The group equally hit Asari Dokubo hard who had been saying unpleasant things against Tompolo over the pipeline contract, describing him as enemy of the oil rich Niger Delta Region

Chief (Mrs) Rita-Lori Ogbebor had fumed in an interview over the pipeline contract awarded to the former Niger Delta warlord, Tompolo, saying that it will lead to anarchy in the area.

Chief (Mrs) Rita-Lori Ogbebor, had warned the Federal Government to withdraw the N4.5 billion monthly pipeline contract awarded to the leader of Movement for the Emancipation of Niger-Delta (MEND), Government Ekpemupolo aka Tompolo, describing it as invitation to anarchy. For her, the award of the humongous contract sum to one individual in Niger Delta as a clear demonstration of government abdicating its responsibilities to the people and lambasted the Federal Government for failing in it’s responsibility to manage oil resources in Niger Delta and maintaining peace in the country.

But NDMRC, an oil monitoring group in the region in a Press Statement signed by its President, Nelly Emma, Secretary, John Sailor and Public Relations Officer (PRO), Stanley Mukoro, and made available to newsmen on Tuesday, September 13th, 2020, lamented the position of Chief (Mrs) Rita-Lori Ogbebor on the pipeline contract, imploring her to shun tribal sentiment and promote unity among the people of the Niger Delta Region.

“Our attention has been drawn to the outburst of Chief (Mrs) Rita-Lori Ogbebor on the award of the pipeline contract to Tompolo and we must say that we are sadden by her position on the issue. It is very sad and painful that at a time that we are talking about how to promote national unity and halt the unabated illegal oil bunkering in the oil rich region, Chief (Mrs) Rita-Lori Ogbebor is bringing tribal issues into the award of the pipeline contract to a respected son of the region, Tompolo. We are highly disappointed with her position on the pipeline contract”, the group said.

The group added that; ” We hate to believe that she is into illegal bunkering hence she is seriously against the award of the pipeline contract to Tompolo because it is only those who are milking the nation high and dry and smiling to the bank with their proceeds from illegal bunkering business will really go against the pipeline contract. For the avoidance of doubt, we want to let Chief (Mrs) Rita-Lori Ogbebor to know that Tompolo has magnanimously sublet the Itsekiri aspect of the pipeline contract to an Itsekiri son, Chief Emani Ayiri in his determination to carry everybody along as far as the pipeline contract is concerned. Chief (Mrs) Rita-Lori Ogbebor is certainly on her own because only recently Itsekiri youths stormed Oporoza, Headquarters of Gbaramatu Kingdom, Warri South Local Government Area of Delta where they declared their support for Tompolo and promised to work with him on the pipeline contract awarded to him by the NNPC and the Federal Government. She should stop promoting tribal war because her children are not on grounds and if there is a crisis today, only innocent children and not her own will be affected and we want to implore the Olu of Warri Kingdom Ogiame Atuwatse 111 to be wary of the kind of chiefs around him so that he is not misled by mischief makers and those promoting tribal war.

While saying that the hard earned reputation of Tompolo was at stake to deliver on the pipeline contract, the oil monitoring group stated that; “The time is really up for those deeply involved in the illegal oil bunkering in the Niger Delta Region that has destroyed the ecosystem in the area and led to lost of revenue by the Federal Government and it is Tompolo that can help the government to halt the illegal bunkering. Let all those who are making so much money from the illegal oil bunkering and who are against the award of the pipeline contract to Tompolo have a quick rethink and accept the reality on ground that Tompolo has come on a rescue mission as he has all it takes to deliver on this national assignment and people like Chief (Mrs) Rita-Lori Ogbebor and Asari Dokubo cannot stop the moving train”.

“We have come across all the unpleasant comments and interviews against Tompolo by Asari Dokubo regarding the pipeline contract and it is unfair and very unfortunate that this same man helped by the former Niger Delta warlord, Tompolo is out saying all kinds of things about a man so much respected throughout the country. Asari Dokubo has forgotten in a hurry how Atake Tom chased him away from Rivers State over 20 years ago and Tompolo sheltered him by giving him aslum to protect him from Atake Tom and his boys and at the end of the day, he paid Tompolo back by snatching the girl friend of the senior brother of Tompolo and ended up marrying her and when returning to Rivers state, the same Tompolo gave him enough boys to follow him back home for his safety and protection”, the group said.

The Group added that; “We have always known Asari Dokubo as a selfish and ungrateful person and so we are not surprised now at the behaviour of Asari Dokubo because his main source of income is coming to an end because Tompolo is out to clean up the system and halt the oil theft for the benefit of all Nigerians and this is not going to be palatable to Asari Dokubo and his co-travellers. Tompolo is not only a leader in Gbaramatu Kingdom, but a respected leader and a man of Honour in the entire Niger Delta Region. Tompolo has been given a job and he will not fail because his reputation is at stake and the game is up for the likes of Asari Dokubo”.

The Group also said that; ” The people of the Niger Delta Region will continue to remain grateful to Chief Government Ekpemupolo, a wonderful son of the Niger Delta Region for drawing the attention of the Federal Government to the neglect of the area and his dogged fight against oil theft in the region. He has helped in securing permanent peace in the Niger Delta Region, protection of critical oil and gas infrastructure, eradication of oil bunkering and increased generation of internal revenue especially in the Maritime sector. Let all stakeholders in the region join forces and give him the necessary support and encouragement as far as this pipeline contract is concerned, he is not doing it for himself, but for the love of our beloved country and the people of the Niger Delta Region. Tompolo is not scared of the likes of Chief (Mrs) Rita-Lori Ogbebor and Asari Dokubo who may be working together against the pipeline contract as he is prepared to expose all those involved in oil theft in the region. He has a mandate from the Federal Government and nobody dare cross his way”.

“We want to sincerely commend President Muhammedu Buhari, the GMD of the new NNPC and Chief of Defence Staff for taking this drastic action in ensuring the award of the pipeline contract to Tompolo to put an end to oil theft in the region. The successful execution of the pipeline contract by our hardworking local contractors in the Niger Delta Region will lead to increase in our revenue that has nose dived due to the unwholesome activities of oil bunkering. Our security agents must beam searchlight on all those kicking against the award of the pipeline contract to Tompolo, they may have skeletons in their cupboards”, the group stated.

Delta Community boundary dispute: Aladja denies destroying buildings in Ogbe-Ijoh

Aladja Community in Udu Local Government Area of Delta State today said denied allegations by Ogbe-Ijoh people that her indigenes destroyed buildings in their community(Ogbe-Ijoh Community)

In an interview with Our Correspondent, the President of Aladja Community Council, Comrade Shell Okakotu GodFirst who was reacting a report in the social media by one Amb. Smart Okosun sai described the report as “false”.

According to Comrade GodFirst, it is not true that indigenes of Aladja Community destroyed in Ogbe-Ijoh Community.
He noted that there is committee r set to do the demarcation between Aladja and Ogbe-Ijoh Communities.

In his words,”That job was done by the Committee. It’s not Aladja indigenes perse.Aladja Community did not go there to do demarcation on their own. So, to me , it’s irrelevant story. The story is a fictitous story.”

Comrade GodFirst pointed out that most of the buildings at the boundary belong to Aladja people stressing that,”some of the building caused the age long dispute between the communities.

Reacting to the seven day ultimatum the Ogbe-Ijoh people issued the Delta State Government to rebuild the houses destroyed, Comrade GodFirst said if the Delta State Government should be ready to to withdraw the security Operatives from the two communities if Ogbe-Ijoh people dares attack them,.
He said the Aladja Community is fully in support of the boundary demarcation by the Delta State Government and not because Aladja Community is afraid of any thing but for the sake of peace, pointing out that there’s so much insecurity in the Country that does not need more troubles to be added.

He insisted that for peace to reign, the Ogbe-Ijoh people should allow the Committee set up by the Delta State Government to do its demarcation job,

An indigene of Aladja Community who does not want his name in print corroborated Comrade GodFirst saying the said Amb. Smart Okosun is misleading the public with the libelous report. “I believe the people of Aladja will not take it likelywith this time around because if he alleged we destroyed any building in Ogbe-Ijoh , he should be able to point out the perpetrators, not just generalizing.

He insisted that a committee was set up the Delta State Government to demarcate the boundary between the communities.

It would be recalled that angry youths under the auspices of Ogbe-Ijoh Warri Kingdom Interest & Defensive Forum,OIDF had accused a purported Aladja/Ogbe-Ijoh boundary committee led by the counterparts of Udu and Warri South West LGA chairmen, Chief Hon. Jite Brown and Hon.Taiye D. Tuoyo of unlawful destruction of houses in Ogbe-Ijoh community in the name of a boundary adjustment.

He added that it does not seek the consent of the Ogbe-Ijoh community to have commenced the destruction of buildings in the community.

The statement reads, “The grand commandant of Ogbe-Ijoh Warri Kingdom Interest & Defensive Forum (OIDF) Gen. Powode Edonghan Ikoro, Action Chairman, Francis Oromoni, Commander Endurance Amaya Ogbe and National president of OIDF Okosu Smart and others led Ogbe-Ijoh youths to verify purported boundary areas but to our surprise, three of Ogbe-Ijoh buildings were demolished without the consent of the owners and even the Ogbe-Ijoh people.

“We, therefore, call on the Delta State Governor, Sen. Ifeanyi Okowa, Udu LGA chairman Jite Brown and Warri South West LGA chairman, Taiye D.Tuoyo to think wisely and bury their evil decisions against the Ogbe-Ijoh people & rebuild the destroyed houses within seven days to avoid a showdown.”

The group also advised Governor Ifeanyi Okowa to call the purported boundary committee led by the counterparts chairmen of the two LGAs to order and possibly focused on LGA boundary adjustment between Udu and WSW LGAs and not communal issues.

According to the group, the two LGA chairmen should work in line with the government decision regarding the boundary adjustment of the affected communities and not follow their illegal arrangement which may incite more crisis in the area.

2022 $15.7bn Fuel Subsidy Projection To Exceed All 36 States’ Budget- Rewane Declares

With  Nigeria’s petrol subsidy bill skyrocketing in 2022, the estimates for the whole year would exceed the total expenditure by all the states of the federation in 2021, which was $9.8 billion, a new report by a member of President Muhammadu Buhari’s Economic Advisory Council and Chief Executive Officer of Financial Derivatives Company Limited (FDC), Mr. Bismarck Rewane, has indicated.

The report came as the Nigerian National Petroleum Company Limited (NNPCL) on Sunday maintained that crude oil theft was taking a severe toll on its performance. NNPCL disclosed that it lost 470,000 barrels of crude oil per day, which amounted to about $700 million monthly, saying this is in addition to security challenges that hinder oil production in some terminals.
Group General Manager, National Petroleum Investment Management Services (NAPMS), Bala Wunti, made the revelation during an interview with journalists in Abuja.

Rewane maintained that the petrol subsidy policy remained economically costly. The economist, in the latest edition of his monthly Breakfast Meeting report held at the Lagos Business School (LBS), noted that while between 2015 to 2020, $5.5 billion was spent on subsidy, in 2021 alone it went up to $3.8 billion, and $6.2 billion in just the first quarter of 2022.

He stated that despite the increase in money available to the Federation Account Allocation Committee (FAAC), even without contributions from the oil sector, many states continued to pile up debts, with frequent defaults in salaries and pensions.

The report said the huge subsidy payments would account for more than half of the N11 trillion budget deficit, which the federal government projected for 2023.

In 2021, according to FDC, all the 36 states spent the equivalent of $9.8 billion, nearly half what the country would spend this year to cover the petrol subsidy payments, largely seen as opaque.

It estimated that with a mere hike of the price of petrol to N215 per litre by December, the federal government could save as much as N1.25 trillion.
In addition, it stated that the federal government could rake in at least N600 billion by adjusting the exchange rate to N470 per dollar, but admitted that removing subsidy could be politically undesirable.

FDC suggested some pathways to fuel subsidy removal as discontinued fixing of prices, opting for gradual removal, and abandoning national uniform pricing, stressing that subsidy administration has been largely abused.

With oil theft and illegal bunkering taking as much as 400,000 barrels per day of the country’s oil production, Rewane said as much as $1.2 billion was lost to the menace every month, which was the combined budget of Osun, Ekiti and Kwara in 2021.

The federal government recently put the current daily spend on maintaining the petrol subsidy at N18.4 billion for 2022.
Last week, Director General of the Budget Office of the Federation, Mr. Ben Akabueze, in an interview, suggested that Nigeria might seek relief from the International Monetary Fund (IMF) if it was unable to address its fiscal challenges.

Akabueze had said, “Essentially, there are two ways countries end up with the IMF. One is voluntary, when they ask IMF for help, or when things get to the grind, where they simply have no other option.

“I don’t see Nigeria going to the IMF voluntarily. It’s a hot issue here in Nigeria. But the honest truth is that if we don’t address our fiscal challenges in a sensible and sustainable matter, we may end up unwillingly with the IMF.”

He, however, stated that Nigeria was not at that desperate situation yet.
Akabueze had added, “We are not there yet. But we could as much stop digging. There is a maxim that if you find yourself in a pit, you should stop digging and start climbing out.

“If we continue to fund regressive deficits, it is tantamount to continuing to dig. If we continue to pass on reasonable opportunities to increase revenues by introducing taxes, it is tantamount to continuing digging.

“Even though I said we should not cut expenditure in total, we need to get more efficient in our spending. If we don’t do that again, it is tantamount to continuing to dig.”

But continuing in the report, Rewane said the country might soon experience increased oil sales, courtesy of the contract recently awarded to ex-militant, Mr. Government Ekpemupolo, also known as Tompolo, which was worth about $1.08 billion in a month.

The report also put average inflation rate for the last five years at 14.38 per cent, relative to the global average of 3.78 per cent and Sub-Saharan Africa average of 9.65 per cent.

Nigeria emerged the country with eighth highest inflation rate in Sub-Saharan Africa and 25th highest in the world, with price rises mainly driven by higher energy and food prices, the report said.

FDC added that the naira had lost at least 94.87 per cent of its value in five years, crossing N715/$, before falling to N645/$ recently, and now trading at N703/$.

Last week, the Organisation of Petroleum Exporting Countries (OPEC) and its allies slashed Nigeria’s production for the month by 4,000 barrels per day, to 1.826 million bpd, as against the 1.830 million bpd allocated in September.

But Nigeria had even before then been unable to meet all of its production allocation, hitting just 1.083 million bpd in the July assessment and falling even lower to 972,000 barrels in August.

NNPCL Loses $700 million Monthly to Crude Oil Theft

NNPCL lamented the heavy toll of crude oil theft on its performance, saying it loses 470,000 barrels per day, which amounts to $700 million monthly, in addition to security challenges that hinder oil production in some terminals.

Wunti, while speaking with some journalists at the weekend during a tour of NNPCL facilities, said the pipelines, particularly, those around Bonny terminal, could not be operated due to the activities of criminals.

He said the number of barrels stolen rose on a daily basis, saying about 270 barrels, supposed to be loaded in Bonny, are no longer going to be loaded because of theft.
According to Wunti, “If you’re producing 30,000 barrels a day, every month, you get 1,940 barrels. So what it means is that you can take it to 270 every four days, calculate it in a month; you will have seven cargos on a million barrels, that’s seven million barrels.

“When you multiply seven million barrels by $100 that is $700 million lost per month, while about 150,000 barrels expected are differed, we are not producing due to security challenges.”
He added, “The Shell Petroleum Company (SPDC) trunk line, TNP transnational pipeline, cannot be operated and this has been like this since March the 3rd that we put in this. Just take your calculator, 150,000, it means if you want to arrive at one million barrels per day, it means every week as a minimum, basically for one week alone, it’s four cargo and four cargo is four million barrels. Four million barrels formula bar or $100 is $400 million. So you can do your calculations by yourself, take whatever price you want, take this to multiply by the number of days that have been shut in since March 3.”

The NAPIMS general manager said Forcados was not completely secured due to some challenges, but assured that they were addressing it, and in two weeks it might be fixed.

According to him, “But we also have Brass, about 100,000 barrels, which is operated by Agip and is also facing insecurity and vandalism.

“Illegal siphoning of crude oil from oil facilities by criminal individuals and groups impacted negatively on revenue to all stakeholders.

He lamented that the quantity of oil delivered into these federal oil terminals in the country had been limited by the activities of pipeline vandals and organised criminals.

Wunti said vandalism caused low crude oil production, interrupted gas supply, countrywide interruption of distribution of petroleum products, refineries’ downtimes, increasing instability in the oil and gas market, “but I will tell you the major thing that affects us.”

He revealed, “Nigeria will suffer for it; the revenues are impacted, so we can only appeal to them to rein in themselves, the oil theft situation is regrettable. It’s not going on across the whole of the Niger Delta, there are trunk lines that are more impacted on, I think the Bonny trunk line ranks highest.

“Our major challenge as a country is our capability to respond and that is as a result of several factors, the terrain as well as some incapacity that we have.”

Commenting on the role of technology in the effort to check illegal activities around the oil facilities in the creeks, Wunti said, “I was in the Saudi Arabia infrastructure twice, and I know what they have. It’s a digital control system; it’s different from our own. Digital control system, it’s like you have the control system of all your assets in one place.
“This is beyond the digital control system; it’s also a security system and we are doing it and to tell you that this was built-in by our in-house software engineers because of the security sensitivities to it, because they are customised, the moment you give to somebody who creates that. So we use a combination of technology to integrate and synchronise and create what we are now confident and comfortable with.

“In the effort of the corporation to meet its financial tasks the corporation maintained industry data on crude and all NGS production and lifting and most importantly, we ensured energy security, ensuring bulk supply of petroleum products to the nation and remit 100 per cent of this to the federation.”

Speaking on synergy with other government agencies, Wunti explained that the Nigerian Midstream and Downstream Petroleum Regulatory Authority, former DPR, and the regulatory commission had issued what they called Bill of Quantity and they also handled vessel clearance and export permits, while the Federal Ministry of Trade and Industry handled the issuance of export permits.

He said, “We also relate with the Nigerian Customs Service, which also helps with the export permit and to also clear all the vessels; and the Central Bank of Nigeria processes all Nigerian Export Proceeds forms, Nigerian export supervision scheme. So, these are all the agencies we deal with, it’s not an NNPC thing, we have to work through all these agencies before a ship can come in and sail”.

The NAPIMS general manager mentioned some of the government agencies at the terminals to include Nigerian Midstream and Downstream Petroleum Regulatory Authority; the Regulatory Commission; the Nigerian Customs at the terminal; NNPC terminal representatives; pre-shipment inspection agents; Nigerian Immigration officials; Nigerian Ports Authority; and Nigerian Port Health Authority.

He stated, “Then recently, the Navy wanted to be at the terminal. In fact, we are trying to deploy them anytime from now. They also want to be at the terminals to see what is going on, because a lot of back and forth has been going on in the recent past, blaming the Navy. So, they now said they want to be there to participate physically in what’s going on.

“You can see what is happening, that it’s not just an NNPC thing, it is all government agencies working together to make sure that each ship that comes at any point in time has all the clearances”.

World Suicide Prevention Day: Group Takes Critical Steps To Create Survival Hope In Delta

As the world marks World Suicide Prevention Day, September 10, 2022, a group under the aegis of Africa Project Against Suicide (APAS) in conjunction with DICI Development Initiative for Community Impact, South-South, Nigeria, has initiated critical plans to create survival hope amongst the youths and students in the Warri axis of Delta State.

The event which is billed to hold at the DICI Resource Centre, Marian Plaza, Airport Road, Warri, has its theme as “Creating Hope Through Action” and the audience will be populated by participants drawn from mostly the secondary and tertiary eduction students’ communities.

According to one of the facilitators of the Project and Secretary of APAS, Dr. Otega Okinono, “In marking the World’s Suicide Prevention Day on the 10th of September this year, we have decided to put together a programme that addresses the major challenges people face to make them want to commit suicide, and that is hopelessness. And so taking a bearing from the theme of this year’s celebration, we have decided to take critical steps in creating hope for the people through action.

“So, the essence of this programme in marking the Suicide Prevention Day is, to educate and enlighten students and peer groups on the current reality of the alarming rate and prevalence of suicide; the causes and prevention”, posited Okinono.

Meanwhile, a number of resource persons had been lined up to add value that will mainstream a way forward of hope and solution to some of the key indicators of suicide. Dr. A.L. Pemu who is the Delta State Coordinator of APAS and Host will be making presentations alongside Dr. Otega Okinono as APAS Secretary, Eza Teshoma (Mental Health Advocate) and of course, Ms. Emira Edjemre (CEO, Well of Wisdom); and these mindset reengineering lessons are expected to strengthen the depressed and weak in hope by stemming a desire to fight off suicide tendencies.
